If you do not agree to these Terms, you must not access or use the Website or Services.

We may update these Terms from time to time. Continued use of the Website after changes constitutes acceptance of the updated Terms.

2. Description of services

Wezesha Africa Organisation operates the Website as a platform to share information about its mission, programmes, and initiatives, and to offer certain products and services for purchase, including but not limited to merchandise, digital content, courses, events, and other offerings as may be added from time to time.

Descriptions, images, prices, and availability of products and services are subject to change without prior notice. We strive for accuracy but do not guarantee that all information is error‑free.

3. Eligibility

Access to the Website is open to all users. However, to purchase products or services, you must have the legal capacity to enter into a binding contract under applicable law and be at least 18 years old, or be purchasing with the involvement and consent of a parent or guardian.

By placing an order, you represent that you meet these eligibility requirements.

4. Accounts and registration

Some features may require you to create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password confidential and not share it with others.
  • Notify us immediately of any unauthorised use of your account.

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

5. Orders, pricing, and payment

  • Orders: All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason (for example, errors in pricing or description, suspected fraud, or unavailability).
  • Pricing: Prices are displayed in the currency shown on the Website and may change without notice. Taxes, duties, and fees (if applicable) will be shown at checkout where calculable.
  • Payment methods: We currently support payment via third‑party processors such as Paystack and mobile money (e.g., M‑Pesa, Airtel Money). Additional methods may be added in future.
  • Payment data: Payment transactions are processed by secure third‑party payment providers. We do not store full card numbers, CVV codes, or mobile money PINs on our servers.

By placing an order, you authorise us and our payment processors to charge the selected payment method for the total amount, including applicable taxes and fees.

6. Shipping, delivery, and risk of loss

Specific shipping options, timelines, costs, and territories will be displayed at checkout and may be updated as our logistics arrangements evolve.

  • Delivery estimates: Any delivery timeframes provided are estimates and not guaranteed. Delays may occur due to factors beyond our control (customs, carrier issues, force majeure).
  • Risk of loss: Unless otherwise stated, risk of loss or damage to products passes to you upon delivery to the carrier or upon receipt, as applicable under governing law.

Detailed shipping and delivery terms will be published on the Website once finalised and will form part of these Terms.

7. Returns, refunds, and exchanges

Our returns, refunds, and exchanges policy will be made available on the Website and may vary by product type and jurisdiction. In general:

  • Refunds or exchanges may be available for defective, damaged, or incorrectly delivered items, subject to proof and within specified timeframes.
  • Certain items (for example, digital downloads, event tickets, or personalised goods) may be non‑refundable unless required by law.
  • You may be responsible for return shipping costs unless the return is due to our error or a defective product.

8. Intellectual property rights

All content on the Website, including text, graphics, logos, images, audio clips, digital downloads, data compilations, software, and code, is the property of Wezesha Africa Organisation or its content suppliers and is protected by Kenyan and international intellectual property laws.

You agree not to:

  • Use the Website in any way that violates applicable laws or regulations.
  • Engage in fraudulent, abusive, or harmful activities, including attempting to gain unauthorised access to our systems or interfering with the proper working of the Website.
  • Upload or transmit viruses, malware, or any code of a destructive nature.

10. Disclaimers and limitation of liability

To the fullest extent permitted by law:

  • The Website and Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non‑infringement.
  • We do not warrant that the Website will be uninterrupted, error‑free, or secure, or that defects will be corrected.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the Website or Services, even if advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to these Terms or the Website shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim, or such higher minimum as may be required by applicable law.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Wezesha Africa Organisation and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Website or Services.
  • Your violation of these Terms.
  • Your infringement of any third‑party rights, including intellectual property or privacy rights.

12. Governing law and dispute resolution

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non‑contractual disputes) shall be governed by and construed in accordance with:

  • The laws of the Republic of Kenya;
  • Applicable East African Community law; and
  • Relevant international agreements to which Kenya is a party.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good‑faith negotiations. If not resolved within 30 days, the dispute shall be referred to and finally resolved by arbitration in Nairobi, Kenya, under the Arbitration Act, 1995 (Kenya), or any successor legislation. The language of arbitration shall be English.

Nothing in this clause prevents either party from seeking urgent interim relief from a court of competent jurisdiction.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

14. Assignment

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to any affiliate or successor in connection with a merger, acquisition, sale of assets, or similar transaction.

15. Entire agreement

These Terms, together with our Privacy Policy and any additional terms referenced on the Website (such as shipping, returns, or specific programme terms), constitute the entire agreement between you and us regarding the use of the Website and Services, and supersede any prior agreements or understandings.
